The Planning and Zoning Commission (P&Z) of the City of Titusville, Florida met in regular session in City Hall Council Chamber located at 555 South Washington Avenue on Wednesday April 19, 2023 at 6:00 p.m.

Chairman Richardson called the meeting to order at 6:00 p.m. Present were Vice Chairman Aton, Secretary Grant, Member Perez, Member Garrod, Alternate Member Childs, Alternate Member Rogers and School Board Member Gilbert. Member Fayson was absent. Also in attendance were Principle Planner Eddy Galindo, Assistant City Attorney Chelsea Farrell and Recording Secretary Laurie Dargie.

Mr. Galindo wanted to state that there was a Small Scale Amendment #11-2022 that was going to be advertised for tonight’s meeting but the meeting date was changed and the advertising was canceled, however some postcard mailings were sent along with a posting on the property and letter to the Brevard County Commission was done, as it includes an annexation request. Mr. Galindo just wanted to let it be known that this will be advertised and scheduled for the May 17, 2023 Planning and Zoning Commission meeting and the June 13, 2023 City Council meeting.

Orange Plumbing Site Plan M-3 Zoning 4125 South Street 

Mr. Galindo gave an overview of this item.

 

Woody Rice of 505 Indian River Avenue Titusville, Florida came to speak in favor of this item. 

 

Larry Graham, property owner, of 2165 Christine Drive Titusville, Florida came to speak in favor of this item. 

 

Stan Johnston of 860 Poinsettia Avenue Titusville, Florida came to speak neither for nor against this item.

 

The Planning and Zoning Commission had discussion with Mr. Galindo, Assistant City Attorney Farrell, Mr. Rice and Mr. Graham concerning clarification as to this ordinance requirement in the M-3 zoning district.

Member Garrod made a motion to approve the plans in the agenda package that was presented at tonight’s meeting. Member Rogers seconded.

Petitions & Requests from Public Present

 

Stan Johnston of 860 Poinsettia Avenue Titusville, Florida came to speak regarding SNJ Oaks site plan being approved by the Planning and Zoning Commission.

 

Chairman Richardson asked for the clock to be stopped on Mr. Johnston. Chairman Richardson said that the Planning and Zoning meeting Mr. Johnston is referring to is July 21, 2021 and Mr. Johnston was not present at that meeting according to the approved minutes and the televised recording. Mr. Johnston disagreed.

 

Mr. Johnston continued to speak about the violation of laws and how he disputed this. Mr. Johnston said he has been sending emails about this and how he disagrees with it.

 

Chairman Richardson requested that staff send Mr. Johnston the meeting minutes from the July 21, 2021 Planning and Zoning Commission meeting.

Reports

 

Accessory Dwelling Units Discussion

Chairman Richardson said he would like for the Planning and Zoning Commission members to be able to visit Orange County, Seminole County and Pinellas County in order to be better informed as to the ordinances they have in place regarding Accessory Dwelling Units (ADU).

 

Assistant City Attorney Farrell cautioned the members from taking any “field trips” together because of the Sunshine Law. 

 

Mr. Galindo suggested maybe the Commission members take their own separate visit to a county and bring back information to the Commission to discuss at a regular meeting.

 

Chairman Richardson asked if a zoom meeting could be setup in order to hear from a representative from each county during a meeting.

 

Assistant City Attorney Farrell also suggested that the Commission members can do fact finding on their own via phone calls, email, or visits on their own without any other Commission members being with them.

 

Chairman Richardson said that the video Mr. Galindo sent out had information from Orange County, Seminole County and Pinellas County. Chairman Richardson asked if Mr. Galindo would send the video to the Planning and Zoning Commission members again.

 

Some discussion took place regarding different topics of concerns regarding Accessory Dwelling Units.

 

Assistant City Attorney Farrell suggested that the Planning and Zoning Commission identify what they would like to review and make a plan regarding what they would like to achieve with the Accessory Dwelling Unit ordinance. 

 

Assistant City Attorney Farrell said that there is an event at the Cocoa Civic Center, Affordable Housing Summit on May 18, 2023 from 9:00am to 4:00pm.  The Commission members can drop in anytime during this event on their own to ask questions and get information.

 

Chairman Richardson said he does not want to ask staff to draft an ordinance at this time.

 

Mr. Galindo reminded the Commission that City Council was looking for recommendations from the Planning and Zoning Commission relating to ADU with regards to potential impacts to neighborhoods and any potential limitations currently in the code that create a barrier which could be reasons why the city does not see many ADU’s in the city limits. Mr. Galindo said that ADU is currently permitted in the city. Mr. Galindo asked the Commission to let staff know if there is specific information that they would like to be provided by staff.

 

 

 

 

Some items that were briefly discussed were the following:

 

  • Historical structures and the use of ADU
  • Size 
  • Flexibility 
  • Impacts to neighborhoods
  • Acceptance into the neighborhoods
  • Commonality and implementation in the neighborhoods 
  • A simplified ordinance – potentially a one page “turn key package” that gives the parameters of ADU

 

Chairman Richardson asked that the Planning and Zoning Commission members be prepared to discuss specifics concerns, changes, or additions that they may want to see in the ADU ordinance.

Member Garrod said he will be unable to attend the May 3, 2023 Planning and Zoning Commission meeting.
