The Planning and Zoning Commission (P&Z) of the City of Titusville, Florida met in regular session in City Hall Council Chamber located at 555 South Washington Avenue on Wednesday August 16, 2023 at 6:00 p.m.

Chairman Richardson called the meeting to order at 6:00 p.m. Present were Vice Chairman Aton, Secretary Grant, Member Moscoso, Member Fayson, Alternate Member Childs, Alternate Member Rogers, and School Board Member Gilbert. Member Garrod and Member Perez were absent. Also in attendance were Principle Planner Eddy Galindo, Senior Planner Christie Anderson, Assistant City Attorney Chelsea Farrell and Recording Secretary Laurie Dargie.

Vice Chairman Aton made a motion to approve the minutes from the August 2, 2023 meeting. Secretary Grant seconded. There was a unanimous voice vote.

Small Scale Amendment SSA#1-2023 – Lieberman Multifamily
Mr. Galindo gave an overview of this item.
Bruce Moia with MBV Engineering in Melbourne, Florida came to speak in favor of this item.
Alice Williams of Titusville came to speak against this item. Ms. Williams provided a handout.
Mary Sphar of Cocoa came to speak against this item. Ms. Sphar provided a handout.
Ralph Warren of Titusville came to speak neither for nor against this item.
Mr. Moia provided a brief rebuttal.
The Planning and Zoning Commission had discussion with the applicant and staff.

Member Rogers made a motion to recommend approval of SSA#1-2023 to amend the future land use and the rezoning with the following two conditions; 1. That the 109.02 acres of wetlands be set aside as a conservation easement 2. That the 5.24 acres being developed be reduced down to 4.99 acres. Secretary Grant seconded.

Member Moscoso voted no based on inconsistency with Comp Plan Policy 1.6.3.2 and the South Street Plan from 2016.

Ms. Anderson gave an overview of this item.

The Planning and Zoning Commission had discussion with the applicant and staff.

Secretary Grant made a motion to recommend approval of SSA# 3-2023 as presented with the staff recommended conditions. Secretary Grant seconded.

Mr. Galindo reminded the Planning and Zoning Commission that the September 7, 2023 meeting has been cancelled and the next regular meeting will be on September 20, 2023.
Mr. Galindo announced that Planner Joshua Mesnick has turned in his resignation and therefore this position will be advertised to be filled.
Assistant City Attorney Farrell asked when the Planning and Zoning Commission would like to view the remaining 90 minutes if the training webinar. The Planning and Zoning Commissions decided to view this at 4:00pm on Wednesday, September 20, 2023.
Member Fayson brought up discussion on affordable housing and the Live Local Act. Member Fayson said that he would like to strongly encourage that the City of Titusville move towards having all new development designate 2% to 5% of the development as affordable housing. Assistant City Attorney Farrell said that this would have to be an ordinance change and she advised that this come back to the Planning and Zoning Commission as a topic of discussion in order to make any formal recommendations.
The Planning and Zoning Commission agreed to have this on their September 20, 2023 regular meeting as a discussion item.
Chairman Richardson announced that he turned in his resignation from the Affordable Housing Committee as he has served on the committee for three years. Chairman Richardson said that a member of the Planning and Zoning Commission needs to be a member of this committee and asked that the P&Z members consider becoming a member to this committee. Member Fayson volunteered to temporally fill this position as he considers the membership. Assistant City Attorney Farrell said that if this is an appointed position by the City Council, Member Fayson will need to make this request to the City Clerk’s office, Wanda Wells, so that it can be put on City Council’s agenda for consideration and vote.
Chairman Richardson said that he would like for the Planning and Zoning Commission term periods to be extended to three (3) years instead of the two (2) year time period that currently exist. Chairman Richardson said he is suggesting this in order to help retain the members and not to lose members every 2 years. Chairman Richardson asked if the Commission would be agreeable for him to ask City Council to extend the term period for three (3) years. The Commission members were all in agreement.
Chairman Richardson said that he was displeased by how Community Development Director Brad Parrish conveyed to City Council the condition that was made regarding the vegetative buffer on the CUP#2-2023 to City Council at their August 8, 2023 meeting. Chairman Richardson said that this is why, in the past, members of the P&Z Commission had to be at the City Council meetings to be sure that the intent was conveyed properly.
Mr. Galindo apologized and said that he believes he may have misunderstood the P&Z Commission’s recommended condition. He wants the P&Z Commission to know that staff tries their best to convey the intent of the motions and conditions to City Council. Chairman Richardson said that he personally spoke to Mr. Parrish before the City Council meeting took place regarding the intent of the motion/condition.
Member Moscoso said that she feels that it is important that a member of the P&Z Commission should be following the City Council meetings in person or in other ways.
Assistant City Attorney Farrell stated that any change to the term period of the Planning and Zoning Commission would need to be a code change.
