Notice
All persons who anticipate speaking on any Public Hearing item must fill out an Oath Card to be heard on that agenda item and sign the oath contained thereon. These cards are located on the table near the entrance to the Council Chamber or may be obtained from the Recording Secretary. This meeting will be conducted in accordance to the procedures adopted in Resolution #24-1997
Those speaking in favor of a request will be heard first, those opposed will be heard second, and those who wish to make a public comment on the item will speak third. The applicant may make a brief rebuttal if necessary. A representative from either side, for or against, may cross-examine a witness.
Anyone who speaks is considered a witness. If you have photographs, sketches, or documents that you desire for the Commission to consider, they must be submitted into evidence and will be retained by the City. Please submit such exhibits to the Recording Secretary.

A. Comprehensive Plan Small Scale Amendment (SSA) No. 7-2023 TRG Self Storage with Annexation
Conduct the public hearing and make recommendation on Small Scale Comprehensive Plan Amendment (SSA 7-2023) with Rezoning and Annexation.
Approve the annexation of the 8.93-acre parcel having Brevard County Property Appraiser Parcel Nos. 22-35-19-AV-*-33.01, 22-35-19-AV-*-34.01, and 22-35-19-AV-*-63. This is a legislative item.
Approve the comprehensive plan future land use small scale map amendment from the Brevard County Industrial Future Land Use category to the City of Titusville Industrial Future Land Use category for the 8.93-acre subject property identified by Parcel Nos. 22-35-19-AV-*-33.01, 22-35-19-AV-*-34.01, and 22-35-19-AV-*-63. This is a legislative item.
Consider the rezoning from the Brevard County IU Industrial Light and IU-1 Industrial Heavy zoning districts to the City of Titusville Light Industrial and Warehousing (M-1) zoning district for the 8.93-acre subject property identified by Parcel Nos. 22-35-19-AV-*-33.01, 22-35-19-AV-*-34.01, and 22-35-19-AV-*-63. This is a quasi-judicial item.
As an alternative, the City could request that the applicant propose a more intense zoning district without a concept plan. Public hearings will need to be advertised for a revised request.
B. Ordinance to allow Assisted Living Facility in the Urban Village (UV) zoning district
Conduct the public hearing and make a recommendation on the draft Ordinance to allow Assisted Living Facility(s) as a permitted use with limitations in the Urban Village (UV) zoning district. This is a legislative item.
C. Brooks Landing, Phase 1 - Re-Plat
Approve the re-plat for Brooks Landing, Phase 1 Subdivision
D. Live Local Act Ordinance and Resolution
Ordinance No. 48-2023 - An Ordinance of the City of Titusville, Florida amending Chapter 29 “Special Districts and Overlays”,
Resolution No. 25-2023 may be approved with the adoption of the Ordinance. The Resolution includes procedures related to developments that qualify under the Live Local Act Chapter 2023-19 Laws of Florida.

Any person who decides to appeal any decision of the Planning and Zoning Commission with respect to any matter considered at this meeting will need a record of the proceedings, and for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
The City desires to accommodate persons with disabilities. Accordingly, any physically handicapped person, pursuant to Chapter 286.26 Florida Statutes, should at least 48 hours prior to the meeting, submit a written request to the chairperson of the meeting that the physically handicapped person desires to attend.
