City’s Statement/Recommendation:

Code Enforcement Officer Mae Wright testified that property remains in compliance. Section 12-23 Junk and Debris had a compliance date of July 18, 2025, and Section 304.14 Windows, Skylights and Door Frames had a compliance date of September 8, 2025. The lien reduction application in the amount of $9,400.00 was received on or about September 17, 2025.

At the time of the Massey hearing, the owner had not been issued nor had the owner received approval to keep the shipping container on the property.

The Magistrate ordered this item to be continued on the November 10th hearing, to allow time for the Respondent to respond to the October 8th review comments from the building department.

Order / Decision:  

The Magistrate ordered Respondents to correct cited violations on the subject property by reestablishing water service with the City of Titusville Water Department by 12:00 PM (noon) on November 7, 2025. Respondent shall notify the Code Enforcement Officer when compliance is achieved so the officer can inspect and confirm compliance. 

 

If compliance with all violations is not achieved by the date given, a subsequent compliance/Massey hearing will be held and the Magistrate may impose a fine in the amount of $50.00 per day, per violation commencing November 8, 2025, and continuing daily until violations are corrected. A lien may also be imposed.

 

In addition to the fine, the City’s costs of prosecution are imposed in the amount of $312.38 payable to the “City of Titusville” and delivered to the Office of the City Attorney at 555 South Washington avenue, Titusville, Florida.

A lien may also be imposed.

The Magistrate ordered Respondents to correct cited violations on the subject property by removing all junk and debris from the property and by either removing all inoperable vehicles or repairing and obtaining current license plates for them by 12:00 PM (noon) on November 7, 2025. Respondent shall notify the Code Enforcement Officer when compliance is achieved so the officer can inspect and confirm compliance. 

 

If compliance with all violations is not achieved by the date given, a subsequent compliance/Massey hearing will be held and the Magistrate may impose a fine in the amount of $100.00 per day, per violation commencing November 8, 2025, and continuing daily until violations are corrected. A lien may also be imposed.

 

In addition to the fine, the City’s costs of prosecution are imposed in the amount of $136.28 payable to the “City of Titusville” and delivered to the Office of the City Attorney at 555 South Washington avenue, Titusville, Florida.
